Oxford street <br /> <br />ACTION REQUESTED: <br /> <br />Vacation of Easement <br /> <br />PLANNING CONSIDERATIONS: <br /> <br />1. BACKGROUND <br /> <br />The Groves own a single family home on a lot at the corner of <br />Oxford street and Ryan Avenue that was originally part of a <br />three-lot easement set aside for storm drainage in a 1956 plat. <br />The City provided storm sewer to the area in 1970, eliminating the <br />need for the easement (see attached plat drawing and letter of <br />explanation from City Engineering Department). The three <br />homeowners affected by the easement should have petitioned the <br />City at that time to vacate the easement, but did not. All three <br />lots are built on. Now the Groves' property is being sold, and <br />the easement creates a title problem. The Groves are requesting <br />the City to vacate the easement on their lot. <br /> <br />The two other lot owners affected by the easement may wish to have <br />the easement vacated on their property as well, but technically, <br />they must request it themselves. The city cannot initiate the <br />process without their consent and proper notice. We have contacted <br />these two owners and advised them of the situation. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />Comprehensive Plan & Zoninq Code References <br /> <br />The property is guided LR Low Density Residential and is zoned <br />R-l. The existing single family home is a permitted use. The. <br />request to vacate the easement does not affect the use of the <br />property from a zoning standpoint. <br /> <br />3. CONCLUSION & RECOMMENDATION <br /> <br />We recommend approval of the vacation request. <br />
