Ed Bossard's Rose Acres No.2 <br /> <br />Dear Marty, <br /> <br />As explained to you over the phone this morning, a blanket drainage easement <br />exists over the above mentioned property. With this "easement on the property, <br />the title company. Universal Title, is not willing to place title insurance <br />on the property. In order for them to consider insuring over the easement, <br />they request a letter from the city of Roseville to include. the following: <br /> <br />1) Adequately explain the nature of the problem. Explain the drainage <br />situation and ~ow it came to be placed there in the beginning. -- <br />2) A statement that city of Rosevil1e is committed to undertake the <br />procedures in vacating the easement. And that the ånticipated <br />process will be completed in December or very first part of 1992. <br />(Or whenever you feel it is reasonable to believe that the vacation <br />process is complete). <br />3) Explain why the city allowed building permits with the easement <br />still in place. <br />4) Explain why the drainage easement is no longer necessary. (That <br />storm sewers are in the street, etc.) <br /> <br />As I stated over the phone, the buyers & sellers of this property wish <br />to close on Friday. Because the attorney for Universal will be mðking a <br />decisiòn based on your letter whether to insure over the easement or not, <br />we ask that you provide this information as soon as possible. <br /> <br />Thank you very muêh for your time and consideration in this matter. <br /> <br />Please call me at 636-5566 when the letter is completed so that I can <br />pick it up and hand carry it to Universãl Title.
