g~b~

REQUEST FOR COUNCIL ACTION

DATE:, 10-28-91
ITEM NO.: "ß-..3

Department Approval:

Manager Reviewed:

Agenda section:

~

~

Consent

Item Description:

Joel and Phyllis Dillner request for a minor
variance at 2192 Acorn Road.

Background:

1. ci ty ordinances require that attached garages have a rear
yard setback of at least 30 feet.

2. Mr. and Mrs. Dillner are requesting a minor variance to allow
them to construct an addition onto their existing attached
garage to add a third garage stall. The proposed addition
would be 10 feet from the rear lot line instead of the
required 30 feet.

3. The Minor Variance Committee unanimously recommended approval
of the minor variance based on the orientation of the
structure on the site and the unusual lot configuration.
4. The Dillner' s also own the adj acent lot which is the only
a~fected property by this request.

Alternatives:

1. Deny the variance based on the finding that no hardship or
practical difficulty exists on the site.

2. Grant the variance based on the finding that there is a
hardship or practical difficulty present on the site.

Policy Ob;ectives:

1. To insure that property is developed in accordance with the
City's zoning ordinance.

2. To grant variances where hardships and practical difficulties
are present.

Staff Recommendation:

1. It is recommended that the City Council approve Joel and
Phyllis Dillner's request for a minor variance at 2192 Acorn
Road.
