<br />Willmus, Case No. 2413 <br /> <br />Page 6 <br /> <br />3) The applicant has assured us there will be no <br />maintenance or cleaning of vehicles on site. <br /> <br />4) The storage of vehicles on site will not interfere with <br />vehicle and pedestrian access and circulation. <br /> <br />5) The applicant has assured us there will be no visible <br />evidence of the use, other than signage in the approved <br />space on the pylon and the building facade. <br /> <br />6) The use will not have a negative impact, based <br />six criteria for evaluating Special Uses in section <br />(except landscaping and trash dumpsters, as <br />previously) . <br /> <br />on the <br />12.035 <br />noted <br /> <br />The following issues are not as clear-cut: <br /> <br />1) Is the storage of vehicles on this site "purely an <br />accessory use", or does it "alter the appearance and <br />character of the property"? The stored vehicles will <br />occupy over a third of the spaces on the site, but they will <br />be at the rear of the building. It is not the maj or or <br />principle use of the property, but neither is it <br />insignificant. <br /> <br />If the Commission believes the use is not accessory, the request <br />could be denied, or modified in some way to make the use fit the <br />term "accessory". If the Commission believes the use is <br />accessory, then the request could be approved, depending on the <br />other issues outlined below. <br /> <br />2) since this use occupies only a portion of a multi-tenant <br />building, do we require the entire site to be brought into <br />complete compliance with the Code and city right-of-way <br />dedication policy? Would these issues be considered <br />"reasonable conditions" to attach to the approval? If so, <br />the following would have to be addressed: <br /> <br />a) The trash dumpsters would need to be enclosed. <br />b) Landscaping would have to be added, both internally and <br />on the Cleveland Avenue boulevard, according to the <br />requirements of the design standards. <br />c) 9.5' on County Road B-2 would have to be dedicated. <br />
