<br />Franklin Ho, Case Ho. 2418 <br /> <br />Page 3 <br /> <br />Fire Marshal & Buildinq Insoector <br /> <br />The remodelling plans for the home to accommodate the duplex <br />arrangement have been reviewed by both the Fire Marshal and the <br />Building Inspector and have been judged adequate. <br /> <br />Enqineerina Considerations <br /> <br />The property currently has one utility service; City policy <br />requires a duplex to have separate water and sewer hookups for <br />each unit. <br /> <br />A duplex would require four parking spaces: two for each unit. <br />There is currently a two-car garage and Mr. Ho proposes to build a <br />paved area to allow for two more parking spaces and enough room to <br />turn around so that all cars can head out onto Cleveland Avenue. <br /> <br />3. CONCLUSION & RECOMMENDATION <br /> <br />Rezoning is a discretionary matter on the part of the city. The <br />Code offers some insight on the issues that might go into your <br />decision, in section 4.010, Puroose. The provisions of the Code <br />"shall be the minimum requirements. . to protect the public <br />health, safety, morals, comfort, and general welfare of the <br />people", and are, in part, for the purpose of "protecting the <br />character and stability of residential. . . areas". The proposed <br />rezoning would meet all the technical provisions of the code, and <br />Mr. Ho proposes to comply with all engineering and utility <br />requirements for the property and structure. The question is <br />whether this request is consistent with protecting the character <br />and stability of the surrounding area. <br /> <br />Mr. Ho notes in his written request that the rezoning would ease <br />the economic burden of living in the house by himself. Economic <br />factors alone are not sufficient reason for the City to grant a <br />zoning request. <br /> <br />The property is relatively isolated and located on a busy <br />thoroughfare. Damaging the neighborhood character is probably not <br />as much of an issue here as it would be in other neighborhoods. <br /> <br />If the Planning commission believes that rezoning this property <br />would be inconsistent with the character and stability of the <br />neighborhood, then you could vote to recommend denial of the <br />request. <br /> <br />If the Planning commission believes that rezoning this property <br />would be consistent with the character and stability of the <br />neighborhood, then you could vote to recommend approval of the <br />request, or recommend approval wi th reasonable condi tions <br />attached. <br />
