Enqineerinq Considerations The property currently has one utility service; city policy requires a duplex to have separate water and sewer hookups for each unit. A duplex would require four parking spaces: two for each unit. There is currently a two-car garage and Mr. Ho proposes ~o build a paved area to allow for two more parking spaces and enough room to turn around so that all cars can head out onto Cleveland Avenue. 3. CONCLUSION & RECOMMENDATION Rezoning is a discretionary matter on the part of the city. The Code offers some insight on the issues that might go into your decision, in section 4.010, Purpose. The provisions of the Code "shall be the minimum requirements. . to protect the public health, safety, morals, comfort, and general welfare of the people", and are, in part, for the purpose of "protecting the character and stability of residen~ial . . . areas". The proposed rezoning would meet all the technical provisions of the Code, and Mr. Ho proposes to comply with all engineering and utility requirements for the property and structure. The question is whether this request is consistent wi th protecting the character and stability of the surrounding area. Mr. Ho notes in his written request that the rezoning would ease the economic burden of living in the house by himself. Economic factors alone are not sufficient reason for the City to grant a zoning request. The property is relatively isolated and located on a busy thoroughfare. Damaging the neighborhood character is probably not as much of an issue here as it would be in other neighborhoods. If the Planning commission believes that rezoning this property would be inconsistent with the character and stability of the neighborhood, then you could vote to recommend denial of the request. If the Planning Commission believes that rezoning this property would be consistent with the character and stability of the neighborhood, then you could vote to recommend appr·oval of the request, or recommend approval with reasonable condi tions attached.
