~+~l

REQUEST FOR COUNCIL ACTION

DATE: 6-08-92
ITEM NO.: ß - 2--

Depart~oval:

Item Description:

Manager Reviewed:

Agenda Section:

~8-

Consent

Robert and Catharine Renner request for
minor variance at 2115 N. Rosewood Lane.

a

Background:

1. ci ty ordinances require that a 10 foot sideyard setback be
provided on lots created after 1959.

2. Robert and Catharine Renner are purchasing a lot that was
created by a lot division in approximately 1986. They wish
to construct a house that would have 5 foot sideyard setbacks
on both sides of the house instead of the required 10 foot
setback. The surrounding area is a 5 foot sideyard setback
area but the houses have been developed with 10 foot
setbacks.

3. The surrounding property owners have indicated their support
for the proposed variance.

4. The Minor Variance Committee unanimously recommended approval
of a minor variance to allow a 5 foot setback on the west
side of the house but that a 10 foot sideyard should be
maintained on the east side to be consistent with the
surrounding area. The Committee felt this was reasonable
because of the fact that the lot is narrower than others in
the area and that the house will be of similar size and fit
in with others in the area. The reduced setback on the west
side would not be a problem because of the angled
configuration and large setback of the adjacent house.

Alternatives:

1. Deny the variance based on the finding that no hardship or
practical difficulty exists.

2. Approve the variance request based on the finding that a
hardship and/or practical difficulty exists.

Policy Obiectives:

1. To insure that development occurs in accordance wi th the
City's comprehensive plan and zoning ordinances.
