BACKGROUND <br /> <br />The Swords own a single family home on Hamline Avenue. The <br />property is zoned R-4, but guided LR. with the reconstruction of <br />Hamline Avenue the property would be assessed several thousand <br />dollars (only R-1 and R-2 land is exempt from the assessments). <br />The Swords do not intend to develop their land in accordance with <br />the R-4 zoning and are requesting a rezoning to R-2, to save the <br />assessment cost and to bring the zoning in line with their <br />intentions. <br /> <br />This lot is adjacent to David Nelson's property which is similarly <br />situated and was recommended for rezoning to R-2 at last month's <br />Planning Commission meeting. A condition to that approval was that <br />the assessment be recorded, but be deferred indefinitely as long <br />as the land is zoned R-l or R-2. If the land is ever rezoned for a <br />higher intensity use the City could collect the assessment. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />Comprehensive Plan & Zoninq Code References <br /> <br />The property is guided LR Low Density Residential, but zoned R-4, <br />Three and Four Family Residence District. The property to the <br />east is guided KR and zoned R-6¡ the property to the south <br />(Nelson) is also guided LR and zoned R-4 but recommended for R-2. <br />Other property nearby is zoned R-2 and R-4 (see attached portion <br />of Zoning Map). <br /> <br />3. CONCLUSION & RECOMMENDATION <br /> <br />The proposed rezoning removes an inconsistency between the <br />comprehensive Plan and the Zoning Map. The request is consistent <br />with surrounding zoning and development and with the Nelson <br />rezoning. We recommend approval of the rezoning to R-2 with the <br />condition that the assessment be recorded but deferred <br />indefinitely. <br />
