BACKGROUND <br /> <br />When the Rosewood Addition was platted an easement was acquired by <br />the city for storm drainage. Since then, the City has installed <br />storm sewer to serve the area, eliminating the need for the <br />easement, but the easement remains in force and is a potential <br />complication for title to the property. The owners of the lot in <br />question (which was split into. two lots in a previous action) <br />asked for vacation of the easement. <br /> <br />In the past, the City has processed a number of these requests by <br />private land owners. When the City built the storm sewer <br />projects, it would have been reasonable to vacate the easements at <br />that time. The City Public Works Department has decided in this <br />case, and in the future, that the city will 'be the applicant and <br />vacate the easements at no cost to the land owner. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />Comprehensive Plan & Zoninq Code References <br /> <br />The property is guided LR Low Density Residential and is zoned <br />R-1. The request to vacate the easement does not affect the use of <br />the property from a zoning standpoint. <br /> <br />3. CONCLUSION & RECOMMENDATION <br /> <br />We recommend approval of the vacation request. <br />
