City ordinances require that detached garages be located in <br />rear yards. The city ordinance also indicates that non- <br />conforming structures cannot be expanded without obtaining <br />the necessary variance. <br /> <br />2. Terry smith has an existing 16x22 garage located in the <br />sideyard. Mr. smith wishes to expand the garage so that it <br />is 20x22. <br /> <br />3. All affected neighbors indicated their approval of the <br />proposed variance. <br /> <br />4. The Minor Variance Committee unanimously recommended approval <br />of Terry Smith's variance request based on the fact that <br />there would be a hardship because to bring the garage into <br />conformance would require moving or demolishing and <br />reconstructing the garage. The proposed expansion would not <br />increase the non-conformity because it is on the side of the <br />garage and not in front of the garage. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship or <br />practical difficulties exist. <br /> <br />2. Grant the variance based on the finding that a hardship or <br />practical difficulty is present on the site. <br /> <br />Policy Objectives: <br /> <br />1. To insure that development occurs consistent with the City's <br />zoning ordinance. <br /> <br />2.
