BACKGROUND <br /> <br />Fine Associates is the developer of the property at county Road C <br />and snelling where Slumber land, Investor's savings, Olive Garden, <br />and Roseville Community state Bank are now built, and they still <br />own Lot 5, the vacant parcel directly north of the Olive Garden <br />restaurant. Olive Garden has experienced heavy parking demand <br />since they opened and some employees park in a remote lot at NCR <br />across Snelling Avenue Frontage Road to the northeast. In an <br />attempt to solve both the parking problem and the sale of Lot 5, <br />Fine Associates has proposed a temporary parking lot on Lot 5 for <br />Olive Garden in exchange for a "For Sale" sign on County Road C on <br />the Olive Garden parcel, as illustrated on the attached drawings. <br /> <br />The request is for an Interim Use Permit for 18 months for both <br />the parking lot and the real estate sign. Although the two items <br />are combined in the agreement proposed by the two parties (Fine <br />Assoc. and Olive Garden), they are separate requests in the City's <br />process. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />The property is guided B Business and is zoned B-1B. Banks and <br />larger restaurants, like Olive Garden, are permitted uses. <br /> <br />The real estate sign proposed by Fine Associates will be a typical <br />4' x 8' wooden painted sign on wood posts, similar to many such <br />signs in the community. But off-premises advertising signs are <br />not allowed by the Code. Within an Interim Use Permit, however, <br />such a use can be allowed for a finite period if the city wishes. <br />Th~ sign itself is no different than what would be allowed <br />(without a permit) if the Olive Garden site were for sale. What <br />makes it different is that the sign is advertising another parcel. <br />
