As your letter and <br />supporting documents point out, what we are asking for falls outside the scope <br />of the existing statute. You have advised us that the two best options open to <br />us are to either try to have the statute rewritten to allow the vehicle sales <br />as we have proposed, or, to propose the used vehicle sales in a manner <br />consistent with the statute as presently written. We have elected to do the <br />latter. <br /> <br />The way we understand the statute, under City of Roseville Zoning <br />Code Section 10.280, para 11, "authorizes the sale of new motor vehicles by a <br />motor vehicle dealer and the sale of used motor vehicles by a motor vehicle <br />dealer, but only in conjunction with sales of new motor vehicles." The City of <br />Roseville defines 'motor vehicle' (City Code No. 5.521) as "any self- <br />propelled vehicle not operated exclusively upon railroad tracks and any <br />vehicle propelled or drawn by a self-propelled vehicle." <br /> <br />We are pleased to announce that MAG NET ENTERPRISES, Ltd. has been <br />awarded the franchise for the sale of new L-Z COMPANY trailers¡ L-Z COMPANY is <br />an OEM manufacturer of single and tandem axle trailers, custom building to <br />client specifications. L-Z COMPANY issues MSO's on its newly manufactured <br />trailers, to its dealers, to facilitate vehicle titling after the sale. <br /> <br />MAG NET proposes to promote the sale of these trailers under our <br />corporate assumed name of FLEET SALES SYSTEMS, INC. A copy of L-Z Co's letter <br />confirming this arrangement is attached. As we are now a new vehicle dealer, <br />as defined by Statute, our request for issue of a Special Use Permit to allow <br />the sale of used motor vehicles at 1918 West County Road C clearly falls <br />within the scope of the current ordinance, and should be approved.
