Owasso Boulevard. Background: 1. James Krautbauer owns an existing dwelling and beauty shop use at 165 S. Owasso Boulevard. The western half of the property is zoned R-1 Single Family Residential and the remainder of the site is zoned B-3 General Business. 2. Mr. Krautbauer wishes to rezone the property to R-2 (2 family dwelling) to allow him to convert the portion of the structure utilized for the beauty shop into a second dwelling unit on the site. 3. The comprehensive Plan indicates that the site should be developed as LR low density residential. Two family dwellings are consistent with this designation. 4. The Planning Commission, on a 5-0-1 vote, recommended that the City Council approve James Krautbauer's request for rezoning from B-3 and R-1 to R-2 with the condition that the driveway width be brought into compliance with City codes within three years. Mr. Krautbauer has objected to bringing the driveway up to code because of the commercial development on adjacent sites and because of the additional expense. 5. At the November 23, 1992 city Council meeting, the Council continued consideration of this matter until January 11, 1993 at the applicants request. On January 11, 1993, the Council continued this matter until February 10, 1993 because the applicant was not present. 6. Staff has talked with Mr. Krautbauer and he indicated he would be withdrawing the application. Staff has not received written confirmation of this, however. Staff Recommendation: 1. It is recommended that the city council accept Mr. Krautbauer's withdrawal of his application for rezoning from B-3 and R-1 to R-2 at 165 S. Owasso Boulevard subject to receiving written confirmation of the withdrawal.
