Owasso Boulevard. <br /> <br />Background: <br /> <br />1. James Krautbauer owns an existing dwelling and beauty shop <br />use at 165 S. Owasso Boulevard. The western half of the <br />property is zoned R-1 Single Family Residential and the <br />remainder of the site is zoned B-3 General Business. <br /> <br />2. Mr. Krautbauer wishes to rezone the property to R-2 (2 family <br />dwelling) to allow him to convert the portion of the <br />structure utilized for the beauty shop into a second dwelling <br />unit on the site. <br /> <br />3. The comprehensive Plan indicates that the site should be <br />developed as LR low density residential. Two family <br />dwellings are consistent with this designation. <br /> <br />4. The Planning Commission, on a 5-0-1 vote, recommended that <br />the City Council approve James Krautbauer's request for <br />rezoning from B-3 and R-1 to R-2 with the condition that the <br />driveway width be brought into compliance with City codes <br />within three years. Mr. Krautbauer has objected to bringing <br />the driveway up to code because of the commercial development <br />on adjacent sites and because of the additional expense. <br /> <br />5. At the November 23, 1992 city Council meeting, the Council <br />continued consideration of this matter until January 11, <br />1993 at the applicants request. On January 11, 1993, the <br />Council continued this matter until February 10, 1993 because <br />the applicant was not present. <br /> <br />6. Staff has talked with Mr. Krautbauer and he indicated he <br />would be withdrawing the application. Staff has not received <br />written confirmation of this, however. <br /> <br />Staff Recommendation: <br /> <br />1. It is recommended that the city council accept Mr. <br />Krautbauer's withdrawal of his application for rezoning from <br />B-3 and R-1 to R-2 at 165 S. Owasso Boulevard subject to <br />receiving written confirmation of the withdrawal. <br />
