City ordinances require that detached garages be located in a <br />rear yard. On a corner lot garages must also be set back a <br />minimum of 30 feet from the side street. <br /> <br />2. The Habermels have an existing substandard garage and a <br />breezeway which is set back six feet from the side street <br />(Marion st). The existing structure is non-conforming <br />because it should also have 30 foot setback from Marion <br />street. <br /> <br />3. The Habermels are proposing to remove the garage and <br />breezeway and replace it with a 22' X 30' detached garage. <br />The garage would have a six foot setback from Marion st. <br />which requires a 24 foot variance. <br /> <br />4. All affected neighbors indicated their approval of the <br />proposed variance. <br /> <br />5. The Minor variance Committee unanimously recommended approval <br />of the Habermels request for a twenty-four foot variance. <br />The group felt there was a hardship present because of the <br />slope on the site and the location of existing windows on the <br />back of the house. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship or <br />practical difficulty present on the site. <br /> <br />2. Approve the variance based on the finding that there is a <br />hardship or practical difficulty present on the site. <br /> <br />Policy Objectives: <br /> <br />1. To insure that development occurs consistent with the City's <br />comprehensive plan and zoning ordinance. <br />
