Co. Rd. C-2 <br /> <br />ACTION REQUESTED: <br /> <br />Vacation of Right-of-Way <br /> <br />1. BACKGROUND <br /> <br />The Farrells' home is on a lot on County Road C-2 which abuts the <br />unbuilt right-of-way of Richmond Street, a one-block-Iong ~egment <br />between C-2 and Millwood. South of C-2, Richmond aligns with <br />Lakeview Avenue; north of Millwood it is Chatsworth Street. The <br />Farrells have requested the vacation of the right-of-way adjacent <br />to their lot. All affected neighbors abutting Richmond approve of <br />the vacation, and the request before the Planning Commission is to <br />vacate the entire Richmond Street right-of-way, not just the <br />segment next to the Farrells. <br /> <br />In 1977 the city vacated the Richmond right-of-way for the <br />neighbor north of the Farrells' property, Robert Dustin. Dustin's <br />lot had frontage on unbuilt Millwood and Richmond, but not on an <br />improved public street. The City Attorney's opinion then was that <br />a lot needed this frontage in order to be built on. There were no <br />plans to extend either Millwood or Richmond, so the compromise was <br />to vacate half of the Richmond right-of-way, giving the Dustin lot <br />30' of frontage on Millwood - the minimum necessary. However, the <br />city vacated the right-of-way in fee title, but reserved an <br />easement for roadway purposes in the Richmond right-of-way, <br />leaving open the possibility of building Richmond Street someday. <br />Dustin could own the land under the easement and use it for <br />frontage, but essentially there is still a GO'-wide street <br />right-of-way reserved along the entire length of Richmond Street. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />Plannina Considerations <br /> <br />Much of the land occupied by the right-of-way is low, dropping off <br />from both Millwood and C-2, and there is a small wetland on the <br />east side of the right-of-way (see attached drawing). There is <br />also significant tree growth along portions of the right-of-way, <br />
