j411J

REQUEST FOR COUNCIL ACTION

DATE: 04-12-93

ITEM NO.: E- JJ

Manager Reviewed:

~

Agenda section:

Consent

Item Description:

John Paulson request for a minor variance at
2561 Fisk street.

Background:

1. ci ty ordinances require front yard setbacks in residential
districts at 30 feet. In the case of an attached garage with
no living space above, the setback is 27 feet.

2. John Paulson is proposing to remodel his home at 2561 Fisk
Street by extending his garage forward and moving the kitchen
behind the garage. The garage, as proposed, would be 19 feet
from the front property line, requiring an 8 foot variance.

3. The Minor Variance Committee unanimously recommended approval
of the variance. The Committee based this recommendation on
the fact that the relatively steep grade and large trees on
both sides of the house, together with the wetland in the
rear yard, prevent expansion in any other direction.
Sufficient room remains in the driveway to park a vehicle
beyond the public right-of-way.

4. All affected adjacent neighbors have been contacted and
indicated their approval of the variance request.

Alternatives:

1. Grant the variance based on the finding that a hardship or
practical difficulty is present on the site.

2. Deny the variance based on the finding that no hardship or
practical difficulty exists on the site.

Policy Obiectives:

1. To insure that development occurs consistent with the City's
comprehensive plan and zoning ordinance.

2. To grant variances where hardship and/or practical
difficulties exist.

staff Recommendation:
