s'?~
~

REQUEST FOR COUNCIL ACTION .

DATE: 5-10-93
ITEM NO.: 'B -b

tment Approval:

Manager Reviewed:

~

Agenda section:

Consent

Item Description:

Steven Pepin request for a minor variance at
1743 Lindy Avenue.

Background:

1. City ordinances require that driveways and parking areas be
long enough to park a vehicle beyond the public right-of-way
on private property.

2. Many parking stalls have existed for years that do not meet
this criteria. with street reconstruction projects, it has
been the city's practice to bring driveways into compliance
or to have the property owners apply for a variance.

3. The applicant is requesting a 13 foot variance from City
codes to allow their existing driveway and parking stall to
remain where it is presently located.

4. The Minor variance Committee unanimously recommended approval
of the variance. The Committee believed that eliminating the
parking stall would make the use of the applicants tandem
garage more difficult. Extending the parking stall would
require the removal of a mature tree.

5. All affected adjacent property owners indicated their
approval of the proposed variance.

Alternatives:

1. Deny the variance based on the finding that no hardship or
practical difficulties exist on the site.

2. Grant the variance based on the finding that a hardship or
practical difficulty is present on the site.

Policy Objective:

1. To insure that development occurs consistent with the City's
zoning ordinances and comprehensive plan.

2. To grant variances where hardship and/or practical
difficulties exist.
