/00
)6

REQUEST FOR COUNCIL ACTION

DATE: 5-24-93

ITEM NO.: 13 - \

Approval:

Manager Reviewed:

Agenda section:

~

Consent

Item Description:

Louis German request for a minor variance at
1910 Dellwood Avenue.

Backaround:

1. City ordinances require that driveways on corner lots be
setback 30 feet from street right-of-way.

2. During street reconstruction projects, it has been the City's
practice to bring driveways into compliance with code
requirements or have the property owner seek a variance.

3. Mr. German is seeking a 15 foot variance from the setback
requirements from street right-of-ways to allow his driveway
to remain in its current location.

4. The Minor variance Committee unanimously recommended approval
of the variance. It was the committee's belief that moving
the driveway would make access to the garage difficult and
would require removing mature trees.

5. All affected adjacent property owners indicated their
approval of the proposed variance.

Alternatives:

1. Deny the variance based on the finding that no hardship or
practical difficulties exist on the site.

2. Grant the variance based on the finding that a hardship or
practical difficulty is present on the site.

Policy Obiective:

1. To insure that development occurs consistent with the city's
zoning ordinances and comprehensive plan.

2. To grant variances where hardship and/or practical
difficulties exist.

Staff Recommendation:

1. It is recommended that the City Council approve Louis
