This request is be made based upon: <br /> <br />A. We purchased this property in Ju1y 1989 and no disclosure of violation of <br />existing city, county or state codes pertinent to this property were disclosed at that <br />time. The site plan showing property lines, location of all existing structures and lay <br />out of the property was presented. <br /> <br />B. Restructuring our driveway south is hampered due to the existence of a <br />large conifer tree. Removal of said tree wou1d devalue the property, be extremely <br />costly and not be environmentally sound. Furthermore, as recently as 2 years ago a <br />large Elm tree was removed due to the existence of Dutch Elm disease and the <br />removal of this tree wou1d leave our front lawn devoid of trees. <br /> <br />c. The reconstruction cost of the driveway wou1d be financial prohibitive at <br />this time due to the assessment cost pending for road reconstruction as well as <br />possible private sewage line replacement cost. <br /> <br />D. Roselawn is poorly constructed and does not have curb and gutter facility <br />to properly drain rain and snow run off. Existing water run off has not been <br />properly channeled to sewage main holes although I have requested this service <br />from the county. As such, we have excess run offinto the existing driveway from the <br />North. Eliminating nine feet of driveway which helps to channel this run off wou1d <br />prevent this save drainage of water. This wou1d then increase ice condition in the <br />main part of the driveway and produce dangerous condition during long period in <br />the winter. <br /> <br />E. We formu1ated a landscaping plan in 1989 based upon the property layout <br />as is and have enacted upon this plan since that time. This has required much hard <br />work and required expensive investment into topsoil, wood bark, plants and trees. <br />Restructuring the driveway, would require a reassessment of the landscaping plan, <br />possible delay in its' completion and further unnecessary expense. <br />
