<br />AGREEMENT POR INSPECTION AND SOIL TEST <br /> <br />THIS AGREEMENT is made an entered into this /1 day of May, <br />1993 by and between the City of Roseville, a Minnesota municipal <br />corporation, hereinafter called wRosevillew and Lexart Properties, a <br />Minnesota partnership, hereinafter called .Owner.. <br />WHEREAS, Owner is the owner of certain real property located at <br />the southwest corner of Lexington Avenue North and County Road B in <br />the City of Roseville, County of Ramsey and State of Minnesota, <br />legally described as follows: Lots One, Two and Three, Block One, <br />Lexart Addition, Ramsey County, Minnesota (hereinafter called <br />.Subject property.); and <br />WHEREAS, Owner has entered into a Purchase Agreement dated <br />April 2, 1993 to sell the Subject Property to Roseville Lutheran <br />Church in contemplation of exchanging all or part of the Subject <br />Property with Roseville; and <br />WHEREAS, said Purchase Agreement grants rights to Roseville <br />Lutheran Church and its agents to inspect and make soil tests on the <br />Subject Property, and Roseville wishes to conduct its own inspection <br />and tests for the purposes of determining whether it wishes to <br />accept Assignment of some or all of Roseville Lutheran Church's <br />rights and obligations under said Purchase Agreement; <br />NOW, THEREFORE, in consideration of the foregoing and the terms <br />and conditions hereinafter set forth, the parties agree as follows: <br />1. Roseville and its agents, prior to June 28, 1993, shall <br />have the right of ingress and egress over and through the Subject <br />Property for the purpose of inspecting the same, making test <br />
