2. The Parties agree that nothing in this Agreement shall restrict, impair, or prohibit the City <br />from exercising any other right, regulation, ordinance, or control of any lawful kind over <br />the Property or building construction or improvements thereon. <br />3. AutoZone warrants that no other person or entity has claimed or now claims any interest <br />in the subject matter of this Agreement and that the undersigned representative of <br />AutoZone has the legal right and authority to execute this Agreement on its behalf. <br />4. The Parties agree that the recitals contained in and the Exhibits referenced in the <br />preamble to this Agreement are made a part of the terms, provisions, and conditions of <br />this Agreement, and shall be binding on the parties as if fully set forth within the <br />Agreement. <br />5.
