City ordinances require that driveways on corner lots be <br />setback 30 feet from street right-of-way. <br /> <br />2. During street reconstruction projects, it has been the city's <br />practice to bring driveways into compliance with code <br />requirements or have the property owner seek a variance. <br /> <br />3 . Mr. Schreiber is seeking a12 foot variance from the setback <br />requirements from street right-of-ways to allow his driveway <br />to remain in its current location. <br /> <br />4. The Minor Variance Committee unanimously recommended approval <br />of the variance. The Committee believed that moving the <br />driveway would require removing a mature tree. <br /> <br />5. All affected adjacent property owners indicated their <br />approval of the proposed variance. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship or <br />practical difficulties exist on the site. <br /> <br />2. Grant the variance based on the finding that a hardship or <br />practical difficulty is present on the 'site. <br /> <br />Policy Objectives: <br /> <br />1. To insure that development occurs consistent with the City's <br />zoning ordinance and comprehensive plan. <br /> <br />2. To grant variances where hardship and/or practical <br />difficulties exist. <br /> <br />staff Recommendation: <br /> <br />1. It is recommended that the City Council approve Albert <br />Schreiber's request for a 12 foot minor variance at 1896 <br />
