Everyone is in agreement that this line is an <br />elevation of 886'-6.... In addition, a line showing where the vegetation changes from <br />predominately aquatic to predominately terrestrial was requested if it should differ from <br />the NHW line and that setbacks should be taken from the most restrictive of these two <br />lines. When our surveyor requested clarification of this vegetation line we were. told by <br />Doug Strong that the City of Roseville would turn to the MNDNR to determine that line. <br /> <br />Marty Rye and Dave Potocnik indicated that in making a determination of the <br />NHW line for Lake Owasso, changes in vegetation were considered and that 886'-6" <br />represents the MNDNR's determination of where the vegetation changes from <br />predominately aquatic to predominately terrestrial. It is possible that aquatic vegetation <br />could occur at higher elevations but because it is affected by yearly water fluctuations, a <br />precise measure of this line would be constantly changing. Therefore it is 886'-6" that the <br />DNR would enforce. Aquatic vegetation higher than this would not be directly controlled <br />by the DNR. <br /> <br />You have agreed therefore that on Lake Owasso, 886'-6" is both the NHW line and <br />the line representing changes in vegetation from which our building and parking setbacks <br />are to be taken. We are proceeding with our survey and the design of our building based <br />on this understanding.
