~0q~

REQUEST FOR COUNCIL ACTION

DATE: 7-26-93
ITEM NO.: 13-:LJ

Manager Reviewed:

Agenda section:

~

Consent

Item Description:

Steven Favilla request for a minor variance at
2451 Simpson st.

Backaround:

1. City ordinances require that driveways and parking areas be
setback five feet from the side property lines.

2. Mr. Favilla is proposing to add to his existing driveway to
provide enough room for two cars to park side by side and
allow passengers to exit onto a hard surface as well as
provide an off-street parking area for their recreational
camper trailer. The recreational vehicle parking area would
be to the side of the garage and, as proposed, would extend
to within 2 feet of the side property line, therefore,
requiring a three foot sideyard setback variance.

3. The Minor Variance Committee unanimously recommended approval
of the variance. The Committee believed the variance request
was reasonable in that, it allowed for the parking of the
recreational vehicle in a location consistent with City
ordinances. Because the house and the property line are not
parallel, the variance is only for the front corner of the
parking space.

4. All affected adjacent property owners indicateg their
approval of the proposed variance.

Alternatives:

1.' Deny the variance based on the finding that. no hardship or
practical difficulties exist on the site.

2. Grant the variance based on the finding that a hardship or
practical difficulty is present on the site.

Policy Objective:

1. To insure that development occurs consistent with the City's
zoning ordinances and comprehensive plan.

2. To grant variances where hardship andlor practical
difficulties exist.
