Paul <br /> <br />February 8, 1993 <br /> <br />Mr. Rick Jopke <br />Assistant Community Development Director <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, Minnesota 55113 <br /> <br />Re: Above Ground storage Tanks <br />Our File No. 1011-19 <br /> <br />Dear Rick: <br /> <br />, <br />If the City has an ordinance that prohibits above ground storage <br />tanks in all areas except certain specified areas within the <br />City, exceptions cannot be granted by variance unless the City <br />adopts an ordinance similar to the one I sent you previously. <br />Variances deal with performance standards such as set backs, lot <br />widths, etc. Variances cannot be used for land use issues, <br />unless there is an ordinance specifically providing for that. <br /> <br />If a variance was used in the past, it was probably inappropri- <br />ately used and I would not continue that procedure in the future. <br /> <br />Is there a possibility that there is something in the Uniform <br />Fire Code that might cover variances for such uses? I am not <br />aware of any provision in the fire code.
