<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 8-09-93 <br />ITEM NO.: Q. - ~ <br /> <br />l5fì0 <br /> <br />Mana~Viewed: <br /> <br />Agenda Section: <br /> <br />Department Approval: <br /> <br />Hearings <br /> <br />Item Description: <br /> <br />Consider ordinance amending section 34.030 of <br />the Roseville City Code - above-ground fuel <br />storage tanks. <br /> <br />Background: <br /> <br />1. section 34.030 of the Roseville City Code, has designated an <br />area in Roseville for above-ground storage fuel tanks. <br />Generally described, that area is north of State Highway 36 and <br />west of Cleveland Avenue, bordered both on the north and west <br />sides by the Roseville City limits. In a memo dated January <br />18, 1993, the City's legal council has indicated that <br />permission to allow above-ground storage tanks outside of this <br />designated area cannot be accomplished by a variance. The memo <br />also indicates that should the City want to allow such storage <br />in other than the designated area, an amendment to the City <br />ordinance would be necessary. suggested language for such an <br />ordinance amendment is contained in the attached memo from <br />legal counsel. <br /> <br />2. Minnesota Coaches Inc. operates a fleet of buses from their <br />facility at 1743 W. County Road C. They would like to update <br />their current fueling facilities with a new high capacity <br />above-ground diesel fuel tank. Their location is outside of <br />the designated area where above-ground fuel storage tanks are <br />permitted. Therefore, in order to consider this or similar <br />requests, ordinance language similar to that mentioned in <br />Paragraph 1 would need to be considered. <br /> <br />Alternatives: <br /> <br />1. Amend the City's ordinance by adding language that would allow <br />the City Council to consider such applications on a case by <br />case basis and consider this application at a subsequent <br />Council meeting. <br /> <br />2. Maintain the City's ordinance as is, restricting above-ground <br />fuel storage tanks to that area designated in section 34.030. <br />
