EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota, was held on the 9th day of June 2014 at 6:00 p.m. <br /> The following members were present: McGehee, Willmus, Laliberte, Etten, Roe <br /> and the following members were absent: None. <br /> Council Member Willmus introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 11152 <br /> A RESOLUTION VACATING A PORTION OF UNUSED RIGHT-OF-WAY AT <br /> 2501-2699 PATTON ROAD <br /> WHEREAS, Lakewest and Commers Enterprises Southtown owns the property at 2501- <br /> 2699 Patton Road and has applied for vacation of unused right-of-way; and <br /> WHEREAS, the property is legally described as: <br /> That part of Patton Road as dedicated in the plat of Patton Business Addition,Ramsey County, <br /> Minnesota, lying southerly of the easterly extension of the north line of Lot 3, Block 1,Patton <br /> Business Addition,Ramsey County,Minnesota,and lying westerly of the northerly extension of <br /> the east line of said Lot 3; <br /> WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br /> proposed VACATION on May 7, 2014, voting 5 —0 to recommend approval of the use based on <br /> testimony offered at the public hearing as well as the information and findings provided with the <br /> staff report prepared for said public hearing; and <br /> WHEREAS, the Roseville City Council has determined that the vacation would be in the <br /> public interest; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF ROSEVILLE, MINNESOTA: <br /> 1. That the City of Roseville hereby vacates the portion of Patton Road right-of-way legally <br /> described above. <br /> 2. The vacation applies only to the right-of-way described in Provision 1 above and not to: <br /> (a)the rights of existing utilities, if any; or(b) any other easements running to or <br /> benefitting the City of Roseville, if any. <br /> 3. The City Manager is directed to execute and record a Notice of Completion of this <br /> vacation proceeding pursuant to Minnesota Statutes §412.851. The vacation authorized <br /> by this Resolution shall not be effective until the Notice of Completion is recorded in the <br /> office of the Ramsey County Recorder. <br /> The motion for the adoption of the foregoing resolutions was duly seconded by Council <br /> Member McGehee, and upon vote being taken thereon the following voted in favor thereof: <br /> McGehee, Willmus, Laliberte, Etten, and Roe; <br /> Page 1 of 3 <br />
