REQUEST FOR COUNCIL ACTION

DATE:

8-09-93

ITEM NO.: lJ - ól.J

Department Approval:

Manager Reviewed:

Agenda section:

¥

~

Consent

Item Description:

Linda Luna request for a minor variance at 1259
Oakcrest Avenue.

Background:

1. City ordinances require that the sideyard setback for attached garages be
5 feet from the property line.

2. Mrs. Luna would like to put a 7 foot 2 inch wide addition onto her existing
garage. This would require a 2 foot 10 inch sideyard variance.

3. The Minor Variance Committee unanimously recommended approval of the
variance. It was the Committee's belief that Mrs. Luna's addition would
allow them to have a two car garage and decrease on-street parking in the
neighborhood.

4. All affected adjacent property owners indicated their approval of the
proposed variance.

Alternatives:

1. Deny the variance based on the finding that no hardship or practical
difficulty exists on the site.

2. Grant the variance based on the finding that a hardship or practical
difficulty is present on the site.

Policy Objective:

1. To insure that development occurs consistent with the City's zoning
ordinances and comprehensive plan.

2. To grant variances where hardship and/or practical difficulties exist.
Staff Recommendation:

1. It is recommended that the City Council approve Linda Luna's request for 2
foot 10 inch minor variance for a garage addition at 1259 Oakcrest Avenue.

Council Action Requested:

1. Motion to approve Linda Luna's request for a 2 foot 10 inch minor variance
for a garage addition at 1259 Oakcrest Avenue.
