REQUEST FOR COUNCIL ACTION

DATE: 12-13-93
ITEM NO.: ç - d-.-

Department Approval:

NF¡bPW

Manager Reviewed:

~~

Agenda Section:
Reports and
Recommendations

Item Description:

Peter Nasvik/Welsh Companies Inc. request for
an amendment to a special use permit for an
amusement center at 1655 W. County Road B-2.

Background:

1. In September of this year, Lava Links applied for an amendment
to an existing special use permit to expand their amusement
center at 1655 W. County Road B-2. The proposal included
building a floor over the 2400 sq. ft. lower level to provide
two levels. The upper level was proposed to become an
amusement area offering a variety of skill and arcade games.
The lower level was proposed to become private party space. In
addition, Lava Links was proposing to add 1700 sq. ft. of space
immediately adjacent to the west side of their store. In that
area, they were proposing an upscale parlor gameroom offering
air hockey, foosball, pool tables, darts and additional private
party opportunities. The number of games was proposed to
increase from the 16 games currently licensed at the location
to 45 games. The Planning Commission and staff recommend
approval of the amendment and additional licensing. A copy of
that report is attached.

2. At the September 27, 1993 City Council meeting, the City
Council denied Peter Nasvik/Welsh Companies Inc. request for an
amendment to a special use permit for an amusement center at
this location. On October 11, 1993, the city Council adopted
a resolution denying this request.

3. Since that time, the applicants have invited a number of the
members of the Council to their facility, as well as met with
Chief Zelinsky of the Police Department. Based on these
discussions, it was suggested that the Lava Links people appear
before the Council Work Session to informally discuss a
modified proposal. This proposal would eliminate the 2400 sq.
ft., two level portion of their space from the proposal and
limit the expansion to the 1700 sq. ft. space adjacent to the
Lava Links facility. At the Work Session, the applicant
indicated that they would limit the number of games to 36, down
from their initial proposal for 76 games. Following the
presentation by the applicant, it was determined that if the
Council wanted to further consider the applicant's revised
plan, it would be necessary for the Council to move to

r
