<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: <br /> <br />8-09-93 <br /> <br />ITEM NO.: ~ ~3 <br /> <br />D~partment Approval: <br /> <br />~ <br /> <br />Manager Reviewed: <br /> <br />Agenda section: <br /> <br />~( <br /> <br />Consent <br /> <br />Item Description: <br /> <br />Randall and Lynn Starr request for a minor <br />variance at 1765 Chatsworth Street. <br /> <br />Background: <br /> <br />1. City ordinances require that sideyard setbacks for attached garages be 5 <br />feet from the property line. <br /> <br />2. Mr. Starr would like to put a 18 foot 3 inch wide garage on his property. <br />This would require a 2 foot sideyard variance. <br /> <br />3. The Minor Variance Cornrni ttee unanimously recommended approval of the <br />variance. It was the Committee's belief that Mr. Starr's request was <br />reasonable in that he currently does not have a garage and this would <br />decrease on-street parking. One other hardship that exists is that building <br />the garage in the rear yard would require the removal of a mature maple <br />tree. <br /> <br />4. All affected adjacent property owners indicated their approval of the <br />proposed variance. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship or practical <br />difficulties exist on the site. <br /> <br />2. Grant the variance based on the finding that a hardship or practical <br />difficulty is present on the site. <br /> <br />Policy Objective: <br /> <br />1. To insure that development occurs consistent with the City's zoning <br />ordinances and comprehensive plan. <br /> <br />2. To grant variances where hardship and/or practical difficulties exist. <br /> <br />Staff Recommendation: <br /> <br />1. It is recommended that the City Council approve Randall and Lynn Starr's <br />request for a 2 foot minor variance for a garage at 1765 Chatsworth Street. <br /> <br />Council Action Requested: <br /> <br />1. Motion to approve Randall and Lynn Starr's request for a 2 foot minor <br />variance for a garage at 1765 Chatsworth Street. <br />
