<br />18.220, <br /> <br />ZONING CODE <br /> <br />I) <br /> <br />2. Variances. Variances to the setback requirements may be <br />granted under the following circumstances by the City <br />Council, if not within a flood way: <br /> <br />A. In areas where development exists on both sides of a <br />proposed building site, water and road setbacks may be <br />varied to conform to the existing established setbacks. <br /> <br />B. In areas of unusùal topography or substantial elevation <br />above the lake level, the water setback may be varied to <br />allow a riparian owner reasonable use and enjoyment of <br />his property. . <br /> <br />C. Before the City council may consider such variance, the <br />applicant shall secure and present written statements <br />from owners of property contiguous to the affected yard <br />for which the variance is requested, specifically noting <br />no objection and consenting to. such variance. The City <br />Council shall determine, without an abstract or certifi- <br />cate, the names of such property owners. <br /> <br />3. Grading and Filling. Grading and filling in shore 1 and areas <br />or any alterations of the natural topography where the slope ,)_,) <br />of the land is toward a public water or a watercourse <br />leading to a public water' must be authorized by a condi- <br />tional use permit obtained from the City Council. The permit <br />may be granted subject to the conditions that: . <br /> <br />A. The smallest amount of bare ground is exposed for as <br />short a time as feasible. <br /> <br />B. Temporary ground cover, such as mulch, is used and <br />permanent ground cover, such as sod, is planted, <br /> <br />C. Methods to prevent erosion and trap sediment are <br />employed, and <br /> <br />D. Fill is established to accepted engineering standards. <br /> <br />18.230. Subdivision Reaulations. <br />1. Land Suitability. No land shall be subdivided which is held <br />unsuitable for the proposed use by . the City. Council for <br />reason of flooding, inadequate drainage, soil and rock <br />formations with severe limitations for development, severe <br />erosion potential, unfavorable topography, inadequate water <br />supply, or. sewage disposal capabilities or any other feature <br />likely to be harmful to the health, safety or welfare of the <br />future residents of the proposed subdivision of the <br />community. <br /> <br />110 <br />
