Based on his belief that he could expand his home toward the <br />lake, as long as he did not cross the vertical plane of the at <br />grade deck closest to the lake, Mr. Kadrie began construction <br />of the kitchen addition. In July, 1993, Building inspection <br />staff noticed the construction and stopped it until the issue <br />of valid building permits and shoreline setbacks could be <br />resolved (building permits are valid for one year) . <br /> <br />6. Staff's interpretation of the shoreline management ordinance <br />would allow Mr. Kadrie to extend his kitchen only to the limits <br />of the existing first floor deck. It is staff's feeling that <br />extending a new deck beyond this point should be interpreted as <br />increasing a substandard dimension and therefore, is prohibited <br />by ordinance. Staff further interprets the code to limit <br />further enroachment on the lower level beyond the existing <br />structural wall (the at grade deck is not considered to be an <br />integral structural element). Mr. Kadrie's view is that the <br />limits of the lower at grade deck established that point beyond <br />which substandard dimensions cannot be allowed and is asking <br />the Council, as the Board of Zoning Appeal, for an <br />interpretation on this matter. <br /> <br />Policy Objectives: <br /> <br />1. To protect the natural ecology and aesthetic environment of the <br />community through the wise development of shorelands of public <br />waters. <br /> <br />staff Recommendation: <br /> <br />1. It is recommended that the City Council, acting as the Board of <br />Zoning Appeals, interpret the provisions of the shoreland <br />management ordinance such that Mr. Kadrie could expand his home <br />to the limits of the existing first floor deck but no further. <br />This would prohibit the extension of the deck around his new <br />addi tion. A building permit for this addition needs to be <br />applied for prior to any further work being completed. <br /> <br />Council Action Requested: <br /> <br />1. Motion to interpret the prov1s1ons of the Roseville shoreland <br />management ordinance in a manner to allow Mr. Kadrie to expand <br />his home and above ground deck only to the limits of the <br />existing first floor deck subject to applying for the <br />appropriate building permit. <br /> <br />staff Report by: Mike Falk <br />
