<br />2. Each permittee shall be jointly and severally liable for all costs and expenses, including <br />attorneys' fees, the city may incur to enforce the conditions of the interim use permit <br />upon any breach thereof by the permittee, or to abate and remove the interim use upon <br />any failure by the permittee to discontinue such use, or to evict the operator of such use, <br />upon the expiration or revocation of the interim use permit. <br /> <br />3. The applicant/property owner agrees to complete fire, life safety, and codes inspection of <br />the modular building and proposed office use with the city fire and building inspectors. <br />Accessible ramps (ADA complaint) shall be provided to the main entry. A scaled <br />drawing of the site locations and setbacks shall be provided. <br /> <br />4. The office interim use shall be for three years and be reviewed administratively each <br />year on or around the anniversary date of approval of the permit, with a compliance <br />report submitted to the City Council and Planning Commission. <br /> <br />5. The building shall not be expanded in size or intensity from the 672 s.f. currently <br />proposed within the structure. All permitted office interim uses shall be restricted to <br />space within the proposed structure. <br /> <br />6. The trash containers shall be stored within the accessory building on the site. Trash <br />collection shall only be permitted during normal residential collection hours 7am to 10 <br />pm weekdays and (9 am to 9 pm weekends) as established and amended in Section 405 <br />of the City Code. <br /> <br />7. No exterior storage on the site shall be permitted. No commercial vehicles may be <br />parked or stored on the site. <br /> <br />8. The applicant or successors shall be responsible for repair of the turf, pavement, adjacent <br />buildings and utilities and removal of all support equipment and materials within 30 days <br />after removal of the interim use structure. <br /> <br />9. The interim use permit shall expire on September 24,2004, unless an application is <br />submitted for a three-year extension of the permit in the May 2004. Upon the expiration <br />date of the initial term of the interim use permit, as established by the City Council, the <br />permit shall automatically expire without action of any kind unless the permit is <br />extended in accordance with Subsection 10 of this Section. <br /> <br />10. Applications for extension shall be filed 120 days prior to the expiration date of the <br />original permit, or the expiration of any extension thereof. Unless the original permit <br />was expressly declared to be nonrenewable, the interim use permit may be extended for <br />additional terms of not more than three (3) years each if the City Council makes all of <br />the findings set forth in this resolution at of the time of each renewal. The City Council <br />shall be the approving authority for any or all extensions of the permit. The Council may <br />refer the application for extension to the Planning Commission for study and <br />recommendations action thereon if the Council determines that special problems or <br />circumstances may exist with regard to the proposed extension. There is no vested right <br />or legal entitlement to an extension and the decision on any application for extension <br />shall be within the sole discretion of the City Council. <br /> <br />3 <br />
