OWasso Blvd. <br /> <br />Backqround: <br /> <br />1. The City of Roseville adopted the shoreline management <br />ordinance in the late 1970' s pursuant to Minnesota State <br />statutes. The stated purpose of the ordinance is to preserve <br />and enhance the quality of surface waters, preserve economic <br />and natural environmental values of shorelands, and provide for <br />the wise utilization of waters and related land resources. The <br />ordinance contains many criteria and standards to control the <br />use of shorelands within the city of Roseville. Most notably, <br />setback requirements from the ordinary high water line of <br />public waters. <br /> <br />2. The shoreland management ordinance provides for use of <br />shorelands in existence prior to the date of enactment of the <br />ordinance that do not meet minimum lot area setbacks or other <br />dimension requirements of the chapter. This section also states <br />that any alteration or addition to a substandard use, which <br />will increase the substandard dimension, shall not be allowed. <br /> <br />3. Mr. Rustad's home, located at 329 S. Owasso Blvd., was built <br />well before the enactment of the shoreland management <br />ordinance. It appears that the lots along S. Owasso Blvd. were <br />originally platted to accommodate lake shore cabins. At its <br />deepest point, along the east property line, Mr. Rustad's lot <br />is only 80 feet deep. The house, as it is currently located, <br />is 33 feet from the ordinary high water mark on the east end of <br />the house and 23 feet from the ordinary high water mark on the <br />west end of the house. <br /> <br />4. As the attached letter from Mr. Rustad indicates, the house <br />under consideration has had a colorful history. A history that <br />has left the house with a distinctive odor. Around City Hall, <br />it has been referred to as the "cat house" because the previous <br />owner housed several animals in the house over a period of <br />years. Over the years, the animals living habits have created <br />a numþer of problems, both for the neighbors in the area and <br />the city, in term of code enforcement issues. The net result <br />
