BACKGROUND <br /> <br />1. The City of Roseville adopted the shoreline management ordinance <br />in the late 1970's pursuant to Minnesota State Statutes. The stated <br />purpose of the ordinance is to preserve and enhance the quality of <br />surface waters, preserve economic and natural environmental values <br />of shorelands, and provide for the wise utilization of waters and <br />related land resources. The ordinance contains many critéria and <br />standards to control the use of shorelands within the City of <br />Rosevil1e, most notably setback requirements from the ordinary high <br />water line of public waters: <br /> <br />2. Development Summalv <br /> <br />~ <br /> <br />1. <br /> <br />The shoreland management ordinance provides for use of <br />shore lands in existence prior to the date of enactment of the <br />ordinance that do not meet minimum lot area, setbacks, or other <br />dimensional requirements of the chapter. This section of the <br />ordinance also states that any alteration or addition to a substandard <br />use, which will increase the substandard dimension sl1a11 not be <br />allowed. <br /> <br />Mr. Rustadts home, located at 329 S. Owasso Blvd. was built well <br />before the enactment of the shoreland management ordinance. It <br />appears that the lots along S.
