<br />.... <br /> <br />PLANNED UNIT DEVELOPMENT AGREEMENT <br /> <br />AGREEMENT ~ dated between the City of RoseviIle ("the City") and <br />Good Value Homes, Inc. C'DeveloperB), <br /> <br />1. Request for Planned Unit Development Approval. <br /> <br />. íhe DEVELOPER has asked the CITY to approve a Planned Unit Development with <br />a total of 54 townhouses on the 5.86 acre parcel in the northeast quadrant of the <br />Highway 36 and Lexington Avenue intersection. The subject property is legally <br />described as follows: <br /> <br />Parcell: <br /> <br />That part of Lot 2, Block 1, Rose of Sharon 2nd Addition, overlying Lots 2 and 3, <br />Block 1~ Rose of Sharon Addition. <br /> <br />Lot 3, Block 1, Rose of Sharon 2nd Addition. <br /> <br />Parcel 2: <br /> <br />Lot 2, Block 1,Rose of Sharon 2nd Addition, exceptthat part overlying Lots 2 and 3, <br />Block 1,Rose of Sharon Addition. <br /> <br />2. Planned Unit Development Approval. <br /> <br />The CITY hereby grants approval of the Final Development Plan and subject to the <br />DEVELOPER'S compliance with the terms and conditions of this agreement. The <br />CITY agrees to approve applications for building permits, provided that said plans are <br />consistent W:th the exhibits which were approved at the concept and final stage of the <br />Planned Unit Development process, and all of the conditions of this agreement have <br />been satisfied. <br /> <br />3. Approval by the CITY. <br /> <br />The CITY hereby approves the Development as shown on the following exhibits. The <br />DEVELOPER shall develop the subject properties in. accordance with the general plans <br />shown on the exhibits, If, however, the exhibits vary from the written terms of this <br />Abrreement~ the written terms shall control, The exhibits include: <br />
