<br />E. Utility plan. <br />F. Landscaping plan <br />G. Boundary survey. <br /> <br />4. Phased Development, <br /> <br />The DEVELOPER shall develop the project in a single phase. Grading plans will be approved if they <br />are in confonnity with the approved preliminary grading plan, and provided that the development be <br />constructed per plans submitted and presented at the October 24, 1994 Council meeting (attached). <br /> <br />5. Comoliancewith Laws and Re~ulations <br /> <br />The DEVELOPER represents to the CITY that the proposed Development complies with all City, <br />County, Metropolitan, State, and Federal laws and regulations, including but not limited to: <br />Subdivision Ordinances, Zoning Ordinances and Environmental Regulations. The DEVELOPER <br />agrees to comply with such laws and regulations. <br /> <br />6. Rezoning, <br /> <br />The CITY conducted hearings to consider the rezoning ofthe SubjectProperty from Church to PUD <br />Planned Unit Development. The CITY agrees to rezone the Subject Property to PUD, subjectto the <br />DEVELOPER'S strict compliance with the approved plans, and the terms and conditions of this <br />agreement. (Minor variations from the approved plans may be approved by the CITY's Design <br />Review Committee, under the direction of the Community Development Director). Substantial <br />departuresffom the approved plans will require an amendment to the Planned Unit Development, in <br />accordance with Section 17 of the RosevilleZoning Ordinance. Failure by the DEVELOPER to <br />commence development activity, in accordance with the Final Development Plans, within one year <br />following the final approval of this Planned Unit Development, will necessitate the approval of an <br />extension of the development schedule by the City Council prior to the expiration of the one year <br />period. If an extension is not applied for, the Council may instruct the Planning Commission to <br />initiate rezoning to the original zoning district. <br /> <br />7. Additional Conditions of Approval, <br /> <br />To insure that the proposed development meets the City's standards for the approval of a planned unit <br />development, as set forth in Section 17 (Roseville) Zoning Ordinance, the Development shall also <br />comply with the following conditions: <br /> <br />a. Roseville's standards for utilities and street construction must be followed. <br />b. Removal of the concrete curb and gutter on Grandview must be done as per Roseville <br />standards. <br />c. The new water services on the existingwatermain in Grandviewmust be tapped by Roseville's <br />Utility Department. The street repair must meet Roseville's standards. The contractor is <br />required to take out the needed pennits at City Hall for this work. <br />d. The location of the proposed new catch basins on Lovell Lane South will have to meet <br />
