Re:lllest for PI:lnneò 1 Jnit Development Approv:lI, The DEVELOPER has asked the CITY to approve an amendment to the Comprehensive Plan from Church to Medium Density Residential, approval of the concept for a planned unit development adding 8 units to the original planned unit development, approval of a preliminary and final plat (including the 8 units) and a private street system at Lexington Avenue and Grandview Avenue. The subjectproperty is legally described as follows: That part of the east half of the south 264.00 feet of the north 592.63 feet of the northwest quarter of the southwest quarter of Section 11, Township 29, Range 23, Ramsey County, Minnesota described as follows: Beginning at the most easterly and northerly corner of Grandview Townhomes, according to the recorded plat thereof in said Ramsey County; thence on an assumed bearing of west, 159.40 feet along the northerly line of Outlot A, in said Grandview Townhomes to the easterly line of said Outlot A, thence North 01 degree 47 minutes 00 seconds west 234.12 feet along the easterly line of said Outlot A to the northeast corner of said Outlot A; thence on a bearing of east, a distance of I30.06feet; thence south 01 degree 47 minutes 00 seconds east 140.07 feet; thence south I8degrees 56 minutes 34 seconds east 99.39 feet to the point of beginning. 2. Planned Unit Development Approval. The CITY hereby grants approval ofthe Final Development Plan and subject to the DEVELOPER'S compliance with the terms and conditions of this agreement. The CITY agrees to approve applications for building permits, provided that said plans are consistent with the exhibits which were approved at the concept and final stage of the Planned Unit Development process, and all of the conditions of this agreement have been satisfied. 3. Approval bv the CITY. The CITY hereby approves the Development as shown on the following exhibits. The DEVELOPER shall develop the Subject Properties in accordance with the general plans shown on the exhibits. If, however, the exhibits vary from the written terms of this Agreement, the written terms shall control. The exhibits include: A. Site plan. B. Site sections. C. Floor plans and elevations. D. Topography plan.
