<br />~ ~ <br /> <br />~ , <br /> <br />PLA~NED UNIT DEVELOPMENT AGREEMENT cr.f. ~~37) <br /> <br />AGREEMENT, dated June 28, 1994 between the City of Roseville (lithe City") and <br />Har- Mar Incorporated ("Developer"). <br /> <br />1. Request for Planned Unit Development Approval. <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development with <br />on a 5.92 acre parceJ afJand, west of Snelling Avenue, between Midway Ford and the <br />Conoco/Jiffy Lube Planned Unit Development on County Road C. The project will <br />consist of four buildings totalling approximately 34,500 sq. ft. of ground floor space. <br />The subject property is legally described as follows: <br /> <br />Lot 2, Block 1, Slawik Park Addition No.3. <br /> <br />2. Planned Unit Development Approval. <br /> <br />The CITY hereby grants approval of the Final Development Plan and subject to the <br />DEVELOPER'S compliance with the tenus and conditions of this agreement. The <br />CITY agrees to approve applications for building pennits, provided that said plans are <br />consistent with the exhibits which were approved at the concept and fmal stage of the <br />Planned Urnt Development process, and all of the conditions of this agreement have <br />been satisfied. <br /> <br />3. Approval by the CITY. <br /> <br />The CITY hereby approves the Development as shown on the following exhibits. The <br />DEVELOPER shall develop the subject properties in accordance with the general plans <br />shown on the exhibits. If, however, the exhibits vary from the written tenus of this <br />Agreement, the written tenus shall control. The exhibits marked approved by City <br />Council on June 28, 1994 include: <br /> <br />A. Site plan. <br />B. Preliminary Plat <br />C. Elevations. <br />D. Grading plan. <br />E. Utility plan. <br />F. Landscape plan. <br />
