<br />EXTRACT OF MINUTES OF MEETING OF THE <br /> <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a meeting of the City Council of the City ofRoseville, County <br />of Ramsey, Minnesota was duly held on the 23rd day of May, 1994 at 5:30 P.M. <br /> <br />The following members were present P. Johnson, Wiski, Mastel, Goedeke and V. Johnson <br />and the following were absent: None. <br /> <br />Member p, Johnson introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO,9 ~ <br /> <br />RESOLUTION RECOMMENDING VACATION OF RIGHT OF WAY <br />EASEMENT AT 480 LOVELL AVENUE <br /> <br />WHEREAS, the City Council held a public hearing to determine whether or not said portion of right· <br />of-way easement in the City of Roseville should be vacated; and <br /> <br />WHEREAS, because the portion ofright-of~way easement at 480 Loven Avenue is not necessary for <br />public purposes~ and <br /> <br />WHEREAS, it would be beneficial to the public interest to vacate said right-of-way easement as <br />described in Attachment II A". <br /> <br />NOW, THEREFORE, BE IT RESOLVED. that the City Council of the City of Roseville hereby <br />vacates the right-of-way easement at 480 Lovell Avenue described in Attachment "N', except <br />easements for public or private utilities, including but not limited to water lines, sewer mains, <br />telephone lines and poles, gas and electric lines and cable TV lines) including the right to maintain the <br />same Of to enter upon such land or portion thereof vacated, to maintain, repair, replace, remove or <br />otherwise attend thereto, existing on the date of this vacation, shall be preserved and maintained by <br />said utility holder pursuant to Minnesota Statutes Section 160.29, <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Member Goedeke, and <br />upon a vote being taken thereon, the following vote in favor thereof; P. Johnson, Wiski, Mastel, <br />Goedeke, and V. Johnson and the following voted against the same: None. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
