<br />UTI LIT YEA S E MEN T <br />09-33~231 <br /> <br />THIS INDENTURE, made this 10th day of May, 1994 by and between <br />. ( ) of the County of Ramsey <br />of the State of Minnesota, parties of the first part, and the CITY OF <br />ROSEVILLE, Ramsey County, Minnesota, a municipal corporation, party of the <br />second part. <br /> <br />WITNESSETH: That in consideration of the sum of $1.00 and other valuable <br />considerations in hand paid by the said party of the second part, said parties <br />of the first part do hereby grant and convey unto party of the second part, its <br />successors and assigns, a perpetual easement for underground utility mains, <br />pipes and appurtenances under and across the following described property in <br />Ramsey County, Minnesota: <br /> <br />That part of Outlot B, Ferriswood, which lies within the following <br />described lines: <br /> <br />Commencing at the Northwest corner of said Outlot B; thence South 0 <br />degrees 20 minutes East (assumed bearing) along the West line of said <br />Outlot B a distance of 20.16 feet to the Southerly line of a 20.0 foot <br />easement; thence North 82 degrees 28 minutes 59 seconds East along said <br />Southerly line a distance of 270.71 feet; thence South 5 degrees 40 <br />minutes 57 seconds West 8.22 feet to a point on the Northwesterly line <br />of a easement, said point being the point of beginning of the lines to <br />be herein described; thence continuing South 5 degrees 40 minutes 57 <br />seconds West 42.20 feet to a point on the Northeasterly line of an <br />easement; thence North 39 degrees West along said Northeasterly line <br />30,0 feet; thence North 51 degrees East along the Northwesterly line of <br />a easement 29.67 feet to the point of beginning and there ter.minating. <br /> <br />According to the plat thereof on file or of record in the office of <br />the Register of Deeds in and for said County and State. <br /> <br />which easement shall include the perpetual rights of said City of Roseville, <br />its successors -or assigns, to construct, maintain, operate and repair <br />underground utility mains, pipes and appurtenances over and across a strip of <br />land hereinbefore described, together with perpetual easement for ingress and <br />egress, all without additional compensation. <br /> <br />TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and <br />appurtenances thereunto belonging, or in anywise appertaining, to the said <br />party of the second part, its successors and assigns, forever. <br /> <br />IN TESTIMONY WHEREOF, the said parties of the first part have hereunto set <br />their hands the day and year first above written. <br /> <br />RETURN TO <br />This instrument was drafted by <br />the City of Roseville, Minnesota <br />Engineering Division <br />2660 Civic Center Drive <br />Roseville, Minnesota 55113 <br />
