<br />(c) Terrestrial vegetation, other than trees <br />(i.e., underbrush and grasses), may be <br />replaced with a lawn, provided an erosion <br />control plan is approved by the City Engineer <br />and properly implemented for the time until <br />the turf is established. <br /> <br />(3) Aquatic Vegetation. <br /> <br />(a) Vegetation located at or below the OHW <br />elevation of a protected water shall not be <br />removed unless a permit is obtained from the <br />Department of Natural Resources. <br /> <br />(b) Vegetation located at or below the Regional <br />Flood elevation for a wetland shall not be <br />removed unless permission is granted by the <br /> <br />,..~......__ 'r.'I__..!__~_ <br />....J.l..y l:.U!!.J.Ut::tH:. <br /> <br />(4) Landmark Trees Not Located ~ithin a Shore or Bluff <br />Impact Zone. <br /> <br />(a) Landmark trees shall not be removed unless <br />authorized by the City Planner. Such <br />authorization shall not be granted unless: <br /> <br />1. A finding is made that the presence of the <br />tree(s) unreasonably inhibits practical <br />use of a property, the tree(s) is <br />diseased, or it presents a public safety <br />hazard. <br /> <br />2. A responsible party (property owner, <br />developer, or city in the case of a public <br />improvement, etc.) agrees to plant four <br />(4) trees of a species aud location <br />acceptable to the City for each healthy <br />landmark tree removed. The size of the <br />new trees shall comply with the standards <br />set forth in the Landscape and Screening <br />Code for new construction. If space is <br />not available on the development site, the <br />replacement trees shall be planted <br />elsewhere in the community, as is <br />acceptable to the City Council. <br /> <br />(5) No person shall remove, cut, trim, or otherwise <br />disturb terrestrial vegetation located within a <br />drainage easement which adjoins a wetland unless <br />authorized by the City Engineer. <br /> <br />200-52 <br />
