1

4,

REQUEST FOR COUNCIL ACTION

DATE: 6-13-93

ITEM NO.: 8.-4

Department Approval:
~f¥

Manager Reviewed:

Agenda Section:

~~

Consent

Item Description:

AI Bentley request for a minor variance at 612 W. Highway 36.

Backexound

1. City ordinances require off street parking be located on private property, not in
the public right-of-way. For many years, Mr. Bentley has had a parking area
adjacent to the street in front of his house.

2. Because of the street improvements cUlTently under way by the City of
Roseville, Mr. and Mrs. Bentley's parking area is not in compliance with City
Code. In order to be incompliance) the parking area would have to be
removed.

3. The Minor Variance Committee unanimously recommended approval of a
variance to allow the Bentley's parking area to remain. It was the Committee's
belief that because the frontage road that the Bentley's live on is only 24 feet in
width and provides for no parking on the street, together with the fact that the
frontage road serves only four houses, that it was reasonable for the parking
area to remain.

4. All affected adjacent property owners indicated their approval of the proposed
vanance.

Alternatives:

1. Deny the variance based on the finding that no hardship or practical difficulty
exists on the site.

2. Grant the variance based on the finding that a hardship or practical difficulty is
present on the site,
