I I I I I I I I I I I I I I I I I I I extend to the territory so annexed; and all facilities owned, maintained or operated by Grantee, located within, under, or over streets, rights of way or public places of the territory so annexed, shall thereafter be subject to all the terms hereof. Upon the annexation of territory not served by the Grantee, the Grantee shall be granteå the non-exclusive right to provide service under this Agreement. SECTION 25 FRANCHISE AREA a) The Grantee must provide service to the entire contiguous area of the City/County within two (2) years of the effective date of this franchise, except those areas annexed to the contiguous area of the City/County which were served by another provider at the time of the annexation, which the Grantee may, at its option, provide service. Should the provider of the wireless communications service, other than the Grantee, in an annexed area cease to proviãe service or withdraw service, then the Grantee must proviðe service to that area with in one (1) year following the cessation of service. When areas are annexed to the contiguous area of the City/County which are not served by another provider, the non-exclusive service provisions of this Franchise shall apply and the Grantee must provide service to said annexed areas. An annexed area shall be considered served by another proviðer if that provider serves at least three percent (3%) of the households or businesses in the annexea area or in the case of undeveloped or industrial land tracks, if the provider has erected working cell sites or acquired, erected or buried backhaul network cable along right of way within the annexed area or in or on bounding streets or right of ways around the annexed area for a distance of eight percent (8%) of the total linear circumference of the annexed area. Actual cell site construction is not necessary. SECTION 26 EXTENSION OF GRANTEE'S SYSTEM By virtue of Section 15, (c) herein above, Grantee has agreed to pay the City/county a portion of its revenues derived or earned by it throughout the City/County. In support of this pledge, Grantee hereby agrees as follows: 1) That it will exert all reasonable diligence at the earliest practicable time, not less than two (2) years following the effective date of this franchise to expand and extend its system and its services throughout the City/County. 24
