<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />AN ORDINANCE ADDING SECTIONS TO ~BE CITY/COUNTY CODE <br />PROVIDING FOR THE ENACTMENT OF A NEW ARTICLE TO REQUIRE <br />A PERMIT FOR AND TO ASSESS FEES FOR METALLIC AND FIBER <br />OPTIC TELEPHONE, TELEMETRY, VIDEO, INTERCOM, DATA AND <br />TELECOMMUNICATIONS LINES, CABLES AND CONDUITS WITHIN THE <br />RIGHTS-OF-WAY walCH PROVIDE INTEkCOM, TOLL AND PRIVATE <br />TELEPHONE AND TELECOMMUNICATIONS SERVICES AND EXCLUDING <br />FROM THESE FEES ALL UTILITIES AND ALL OTHER FRANCHISED <br />SERVICE PROVIDERS USING THE RIGHT OF WAY AND TO SET <br />FORTH THE TERMS AND CONDITIONS FOR SUCH PERMITS. <br /> <br />1.8 Permits for use of the right of way for private <br />telecommunications systems. <br /> <br />2.0 Requirements for Permits and Fees for Private <br />Telecommunications Systems with in the Rights of Way <br /> <br />2.1 No person or firm whether pUblic, private, non-profit or <br />not for profit shall construct, operate or continue to <br />operate a Private Communications System which occupies <br />the streets, public ways and public places within the <br />City/County without having been issued a <br />telecommunications permit by the City/County or a <br />franchise for telephone, telecommunications service, <br />video distribution system or Cable Television or Cable <br />Communications system by the City/County. <br /> <br />2.2 Except a~ hereafter provided, it shall be a term and <br />condition of any Telecommunication Permit issued in <br />accordance herewith that as a part of the consideration <br />supporting the issuance of such Telecommunication Permit <br />and the City/County's permission thereby to occupy and <br />use the streets of the City/County, that the Permittee <br />shall pay each year to the City/County compensation and <br />license fees as follows: <br /> <br />2.2.1 <br /> <br />All applicants shall pay a permit request fee of <br />$300.00 <br /> <br />2.2.2 <br /> <br />For providers of long distance access or long <br />distance service, other than the franchised local <br />exchange carrier, a minimum fee of $Søø.øø per year <br />per cable or $5ØØ.ØØ per year per cable per linear <br />mile or any portion there of for systems extending <br />over 1 mile, whichever is greater or the maximum <br />allowed by law plus the fees set forth in 2.2.5. <br /> <br />For private communications systems owned by a non- <br />franchised entity, a minimum of $SØ0.ØØ per year or <br /> <br />2.2.3 <br /> <br />5 <br />
