<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />2.5 Any holder of a telecommunications permit must be a <br />member of a Utility Notification Center or any <br />subsequent alert and warning system to protect and <br />locate their underground lines and cable. <br /> <br />3.0 DEFINITIONS <br /> <br />For the purpose of this article and any permit in <br />accordance herewith, the following terms, phrases, words <br />and their derivations shall have the meaning given <br />herein unless otherwise specifically provided in this <br />article, unless the context clearly indicates otherwise <br />or unless such meaning would be inconsistent with the <br />manifest intent of the City/County Council. <br /> <br />3.1 "Engineering Department" means the Engineering department <br />of the City/County. <br /> <br />3.2 "Cable System" means a non-broadcast facility consisting <br />of a set of closed transmission paths with associated <br />signal generation, reception and control equipment, <br />under common ownership and control, which ðistributes or <br />is designed to distribute to owners, users or <br />subscribers, the signals of one or more television <br />broadcast stations and other subscriber services with an <br />e~istin9 franchise issued by the City/County. <br /> <br />3.3 "FCC" means the Federal Communications Commission or <br />its legaYly appointed successor. <br /> <br />3.4 "Local Access Transport Area (LATA)" means that <br />geographic area and communications system in which the <br />City/County is located and in which the franchised local <br />exchange carrier or any subsequent telephone company is <br />authorized by the Public Service Commission to provide <br />local exchange access telecommunications services. <br /> <br />3.5 nLocal Telephone Service" means: <br /> <br />3.5.1 The access to a local telephone system, and the <br />privilege of telephonic-quality communication with <br />substantially all persons having telephone or radio <br />telephone stations constituting a part of such local <br />telephone system; or <br /> <br />8 <br />
