I I I I I I I I I I I I I I I I I I I 4.2 The financial, legal, technical and managerial experience and capabilities of the applicant{s}; 4.3 The ability of the applicant(s) to maintain and protect the property of the City/County and to protect the property of the citizens of the City/County during the term of the franchise; 4.4 The value, efficiency and quality of the public service to be provided; and 4.5 The value of any telecommunications facilities and services offered by the applicant(s) to the City/County. 5.Ø Franchise Conditions Any franchise granted pursuant to this authorizing resolution shall be by written agreement which shall include, but not be limited to, the following terms and conditions: 5.1 The term of any issued hereunder franchisee shall not exceed five (5) years 5.2 The compensation to be paid to the City/County shall be adequate anð may incluðe the payment of fees or the provision of facilities or services or both. 5.3 The franchise may be terminated or cancelled in the event of the franchisee's failure to comply with the material terms and conði~ions of the agreement. , 5.4 A security fund in the form of performance bonds shall be established to ensure the performance of the franchisee's obligations under the agreement. Such performance bonds shall not be less than $l,ØØØ,Øøø. 5.5 The City/County shall have the right to inspect the facilities of the franchisee and to order the relocation of such facilities at the direction of the City/County Engineering Department. 5.6 There shall' be adequate insurance and indemnification requirements, as determined by the CitY/County, listing the City/County as additional insureds. 6
