I I I I I I I I I I I I I I I I I I I 0) -Toll Telephone Service" means a telephonic- quality communication for which there is a toll charge which varies in amount with the distance and elapsed transmission time of each individual communication or¡ a service which entitles the subscriber or ùser, upon the payment of a periodic charge which is determined as a flat amount or upon the basis of total elapsed transmission time, to the privilege of an unlimited number of telephonic communi9ations to or from al>l or a substantial portion of the persons having telephone or radio telephone stations in a specified area which is outside the local telephone system area (LATA) in which the station provided with this services is located. p} ·Total Gross Revenues· means all cash, credits, or property of any kind or nature reported as revenue items to Grantee's audited income statements arising from or attributable to the sale, lease, rental or exchange of wireless communications service or equipment by the Grantee within the City/County or in any way derived from the operation of its Wireless Communications System, including, but not limited to, any interconnection between its system in the City/County and any system whatsoever. This sum shall be the basis for computing the fee imposed pursuant to Section 15 (c). Such sum shall not include any vendor discounts or credits nor sales, service, occupation or other excise tax to the extent that such taxes are charged separately from normal service charges and are remitted by the Grantee directly to the taxing authority. , SECTION 3 GRANT AND TERM a} The City/County herein called ·City/County" hereby grants to , herein called "Grantee" the non-exclusive right and privilege to install, maintain and operate within the right-of-way, except as hereinafter limited, of all public streets, parkways, alleys and utility easement strips, public ways and public places within the City/County, herein for convenience called "street" or "streets", its cables, equipment and other conductors, including transmitters, receivers and antennas, with the necessary appertuances, for distribution of any lawful telephonic, audio, video or other forms of optical, electronic or electrical signals (hereinafter referred to as a Wireless Communications system) b) Grantee's right to use and occupy said streets for the purposes herein set forth shall be non-exclusive, and the City/County reserves the right to grant the use of said 9
