The Grantor shall not <br />unreasonably deny the Grantee permission to erect new cell <br />site support structures when existing poles or structures are <br />required to be moved by the Grantor's request to move, <br />modify, change or relocate any part of the Grantee's system. <br /> <br />n) They City/County shall have free use of any <br />poles and support structures in Grantee's system owned by <br />Grantee to carry conductors and or transmitter/receivers for <br />any City/County owned electric, communications or signaling <br />system. <br /> <br />0) It is understood that there may from time to <br />time be within the City/County various streets or easements <br />which the City/County does not have the unqualified right to <br />authorize Grantee to use, because of reservations in favor of <br />the dedicators or because of other legal impediments; <br />therefore, in making this grant, the City/County does not <br />warrant or represent as to any particular easement, street or <br />portion of a street that it has the right to authorize <br />Grantee to install or maintain portions of its system <br />therein, and in each case the burden and responsibility for <br />making such determination in advance of the installation <br />shall be upon the Grantee. <br /> <br />p) If Grantee shall fail to make any repair, <br />remove or relocate any part of its system within a reasonable <br />time, or otherwise perform its obligations hereunder, then <br />the City/County is hereby authorized to do the same at <br />Grantee's expènse and Grantee shall reimburse the City/County <br />for the cost thereof promptly upon receipt of an invoice. <br /> <br />q) Micro cell and pico cell, cell sites are, <br />subject to applicable City/County codes and ordinances, <br />allowed on property zoned or designated ·Commercial" by the <br />City/County code. The Grantee must submit a detailed <br />engineering design drawing of the proposed cell site and a <br />statement of permission to erect the cell site signed by the <br />property owner and notarized (not an agent or <br />representative). This ordinance does not require a property <br />owner to grant access to his property and all terms, <br />conditions, agreements and fees, rentals or other charges or <br />payments are strictly between the property owner and the <br />Grantee. <br /> <br />r) No micro cell, pico cell, cell site, repeater, <br />or translator, serving more than two separate paying <br />customers, both of which must be located at the same address <br />as the address of the cell site, are allowed on "residential" <br /> <br />13 <br />
