"

REQUEST FOR COUNCIL ACTION

DATE: 8-22-94

ITEM NO.: B-1

Department Approval:
~~

Manager Reviewed:

Agenda Section:

~cl

Item Description:

Consent
Mark and Melissa Scott request for a minor variance
at 2824 N. Oxford Street.

Background:

1. Mark and Melissa Scott live at 2824 N. Oxford Street in Roseville. The property
is zoned R-l Single Family and is currently does not have a garage on the
property. The R~1 zoning district requires a 30 foot setback from the front
property line and requires that detached garages be located in the back yard. In
this particular case, the house is setback 76 feet from the street and what is left of
a typical backyard contains several mature trees. Given this situation, the Scott's
would like to build a 24 X24 foot two garage in the side yard of their lot. As the
attached site plan indicates, the garage would be setback from the front of the
house and would be 10-1/2 feet from the side yard property line.

2. The Minor Variance Committee has met with the applicants, reviewed the
proposal, and unanimously recommended approval of a variance to allow the
construction of the detached garage in the side yard of this property. It was the
Committeels belief that the extended setback of the existing house and the desire
to protect mature existing trees in the backyard, were strong reasons to approve
the variance application. The Scott's also indicated that their long range plans
include constructing a breezeway to attach the garage to the house.

3. All affected adjacent property owners indicated their approval of the proposed
variance.

Alternatives:

1. Deny the variance based on findings that no hardship or practical difficulty exists
on the site.
